Refund Policy
Effective Date: 5/24/2026
This Refund Policy applies to all engineering services, subscriptions, AI platforms (OmniStack, OmniGenesis), and urgent production hotfix operations provided by OmniVinco by Kanishk Enterprises. Due to the intensive, high-level nature of custom software engineering and infrastructure architecture, our refund protocol is strictly governed by the following rules.
1. Custom Engineering & Development Services
Strictly No Refunds. Once a Statement of Work (SOW) is signed and an initial milestone or deposit invoice is paid, those funds are completely non-refundable. Development services involve the immediate deployment of our elite engineering resources, intellectual property, and time, which cannot be recovered.
- If you decide to terminate a project mid-development, you are liable for all hours worked and costs incurred up to the date of formal written termination.
- No refunds will be granted for "change of mind", "changes in business direction", or "unutilized hours".
2. Urgent Production Hotfixes & Triage
Emergency triage and hotfix deployments are billed immediately upon engagement. There are zero refunds for emergency interventions, regardless of the ultimate resolution, as you are compensating us for immediate priority access to our top-tier Site Reliability Engineers (SREs).
3. SaaS Subscriptions & AI Ecosystems
For recurring subscriptions to OmniStack or managed hosting environments:
- You may cancel your subscription at any time; however, we do not prorate or refund partially used months.
- Your service will remain active until the end of the current billing cycle.
- Setup fees, migration fees, and one-time infrastructure provisioning fees are 100% non-refundable.
4. Exception Clauses & Dispute Waiver
Refunds are only legally mandated and processed if Omnivinco definitively fails to deliver the core specifications outlined in a binding SOW, and only after a 30-day "cure period" has been granted to Omnivinco to rectify the failure.
Chargeback Waiver: By engaging our services, you expressly agree not to file any unauthorized credit card chargebacks or payment disputes. Any fraudulent chargebacks will be met with immediate legal action, collection agency deployment, and termination of all associated web properties hosted on our infrastructure.
